Taking into consideration currently valid provisions of the Law on waste management (“Official Gazette of the RS”, no. 36/2009, 88/2010 and 14/2016) as well as the Law on environmental protection (“Official Gazette of the RS”, no. 135/2004, 36/2009, 36/2009 – state law, 72/2009 – state law, 43/2011 – decision of the Constitutional Court, and 14/2016), the Republic of Serbia strives to adjust its legislation in this matter with the regulations of the European Union, aiming at the environmental protection and promotion.
Pursuant to the aforementioned target, the Law on waste management stipulates, inter alia, the definition of the organized waste market as the functional framework enabling efficient, sustainable and transparent trade of waste and secondary raw materials. However, the establishment, conditions, way of functioning and the arrangement of the organized waste market was legally transferred to the competence of the Government of the Republic of Serbia and competent ministries.
With this regard, the competent ministry adopted the Rulebook on the content of documentation necessary to be submitted along with the request for issuing the permit for import, export and transit of waste (“Official Gazette of the RS”, no. 60/2009, 101/2010 and 48/2017), which defines the list of the documents necessary to be submitted along with the request for issuance of the permit for non-hazardous waste export.
Taking into account existing laws and bylaws, there is a clear intention of the state authorities to create conditions which would enable the waste which can be recycled to stay in the Republic of Serbia in order to be treated by the local operators, so it can be used again. Having in mind such aim, it is necessary to adjust the existing bylaws or adopt new bylaws which regulate the issue of the treatment of secondary raw materials.
In conclusion, the establishment of the stock market for secondary raw materials represents the attempt of the Republic of Serbia to limit the export of secondary raw materials, all that for the purpose of establishing and organizing the market for secondary raw materials in the Republic of Serbia.
