The Law on Health Care (“Off. Gazette of the RoS”, No. 25/2019) (hereinafter: The Law) which entered into force on 11 April 2020, except for the provision of the Article 115, paragraph 1, item 2 of the Law, which applies upon the expiration of 36 months from its entry into force, in the Article 263 of the Law prescribes that the Serbian Business Registers Agency will take over the Registry of health institutions from commercial courts.
The Registry of health institutions in the Serbian Business Registers Agency will start with its activity from the date of 12 October 2020. With this regard, health care institutions which have been registered in the competent commercial courts have the obligation to harmonize their actions with the provisions of the Law within prescribed deadline, which implies the submission of a registration application and the prescribed documentation for the registration of harmonization in the Register of health institutions before the Serbian Business Registers Agency.

Namely, the procedure of harmonization before the Serbian Business Registers Agency shall last for three months (until 11 January 2021) and shall be performed without any payment of fees. In case of untimely submission of the registration application for harmonization (after 11 January 2021), the submitter will be obliged to submit a proof of payment of the fee in the amount of RSD 4,900.00 to the Serbian Business Register Agency.

The harmonization procedure, as well as the necessary documentation required for registration, is prescribed by the Rulebook on the detailed content of the register of health care institutions and the documentation required for registration (“Off. Gazette of the RoS”, No. 80/2019). In addition, the Serbian Business Registers Agency will keep a Unified record of subjects in health care, which will consist of consolidated information on health care institutions and private practice in the territory of the Republic of Serbia.

In this way, information on all health care providers will be publicly available and consolidated, whether they are in public or private ownership, and all interested persons will be able to see the mentioned information in the registers via official website of the Serbian Business Registers Agency.
